Jan Brewer, the Governor of Arizona will fight a ruling by a federal judge against a section of the tough immigration law in the state. The part Brewer plans to appeal would have made it illegal to harbor illegal immigrants, showed court papers on Thursday.
Legal counsel for Brewer said Arizona planned to appeal the decision to the 9th U.S. Court of Appeals located in San Francisco. They want to remove the block that was place on the measure by a lower court on September 5. However, as of yet no formal appeal has been filed.
The measure made it illegal to shield, harbor or transport any undocumented immigrants within the borders of Arizona. However, Judge Susan Bolton from U.S. District Court barred the measure as part of a ruling that also allowed another key measure in the law to go into effect.
In the controversial provision of “show your papers” which the U.S. Supreme Court upheld, police across the state now must check the person’s immigration status they have stopped, if they suspect the person is illegally in the U.S.
The immigration law in Arizona is the state’s attempt at cracking down on the number of undocumented immigrants that flow across the border from Mexico. It is estimated that over 360,000 undocumented immigrants live in Arizona.
Those opposed to the law said it might lead to the use of racial profiling. The highly controversial law was challenged more than two year ago by the White House administration and made it to the Supreme Court, which ruled in June to uphold certain measures, while striking down others.
